STORE TERMS AND CONDITIONS
Welcome to the Xgrow ecosystem. Before using our store or app, please read the Terms and Conditions below.
§ 1. General Provisions
1. The Terms and Conditions specify the rules for using the Xgrow online store, conditions for concluding and terminating sales agreements, conditions for providing digital services via the Xgrow application (including AI Assistant services), and the complaint procedure.
2. The Seller and application administrator is Piotr Mietliński, operating as an unregistered business (pursuant to Article 5 paragraph 1 of the Polish Entrepreneurs' Law Act of March 6, 2018), with the registered address: ul. Sielawy 21G/33, 61-680 Poznań, Poland ("Seller" or "Xgrow").

§ 2. Technical requirements
1. The Xgrow ecosystem includes hardware controllers and software in the form of applications provided for Android (in the Google Play Store) and iOS (in the Apple App Store).
2. To use all features (especially the Remote mode), a WiFi connection, internet access, and downloading the dedicated, free Xgrow app are required.
3. The devices can also operate in "Local Mode" (exclusively via Bluetooth), with limited functions.
4. The Seller reserves the right that the availability of mobile applications may be temporarily limited or suspended in the initial distribution phases, including due to verification processes by store operators (Google Play, Apple App Store) and development works. Ultimately, mapping the evolution and stabilization of the Xgrow solutions ecosystem, these applications will be permanently made available to a wide audience.
§ 3. Placing and processing orders
1. Orders can be placed 24/7 via the online store. The sale covers the territory of the European Union.
2. The prices given in the store are final prices (in PLN or EUR). The Seller operates an unregistered business and benefits from exemptions embedded in applicable law.
3. The order is forwarded for processing after the payment is credited.
§ 4. Right of Withdrawal and Returns
1. A consumer has the right to withdraw from a remote contract within 14 days without providing any reason.
2. Exclusions: Due to hygiene, protection reasons, the safety of chemical processes for clients, and irreversible changes after contact with substances and the cultivation environment (soil, water, fertilizers): products that have been in contact with fertilizers, the indoor plantation environment (used pumps, tubes, opened fertilizers from the Nutrient Doser line) are not returnable after opening a sealed package and using it.
§ 5. Complaints (Warranty for Physical Defects)
1. The Seller is responsible to the customer under warranty if the sold item has a physical defect. An additional commercial manufacturer warranty on hardware is not provided; the client relies strictly on consumer warranty rights (2 years for hardware modules).
2. The user configures the system independently (including solution dosing).
§ 6. Disclaimer and Exclusion of Liability
The Xgrow system was created to support environmental management and facilitate watering. However, it is not a guarantor of correct cultivation without human participation.
The Seller is not liable for damages (except for willful damage) caused by system failures, software bugs, cloud server downtimes, or loss of communication with control devices. Primarily, the Seller takes no responsibility for destroyed crops, dead plants, flooded rooms, or other material losses of the client, resulting from electronic failures, power outages, pump malfunctions, chemical solution inconsistency, or user configuration errors (Fertigation/Climate Control). Automation carries inherent technical risks.
§ 7. AI Assistant and Virtual Services
1. Xgrow apps allow the use of the "AI Assistant", optionally paid for using Tokens billed on the client's account.
2. Advice and diagnostics returned by the AI Assistant are purely for educational and indicative purposes, and the user holds personal responsibility for their application in a real environment. The Seller does not guarantee the factual accuracy of the AI model in any case.
§ 8. Final Provisions
The Terms and Conditions are governed by Polish law. Any disputes will be resolved by the courts in Poznań. If the commercial conditions of the store change, the user will be informed in advance via email.
